Terms and Conditions

Introduction

These Terms and Conditions ("Terms") govern your use of kavindu.me and any services, digital products or payments made to Kavindu Manahara ("we," "our," or "us"), a freelance software developer based in Sri Lanka. By using this website, accepting a quotation or making a payment, you agree to these Terms. If you do not agree, please do not use our website or services.

Services and Products

We offer:

• Client services: custom web application, API/backend and landing page development, delivered under a written quotation, proposal or invoice ("Quotation")
• Digital products: website templates and other downloadable items listed on our Marketplace

The scope, price, milestones and delivery timeline of each service are defined in its Quotation. Where the Quotation and these Terms conflict, the Quotation prevails for that engagement. Work outside the agreed scope is quoted separately.

Services booked through third-party platforms such as Fiverr are governed by that platform's terms and are paid through that platform, not through this website.

Payments

Payment Methods

Payments made directly to us are processed by Dialog Pay (formerly Genie), a payment service operated by Dialog Axiata PLC and Dialog Finance PLC and approved by the Central Bank of Sri Lanka. We currently accept:

• QR payments: scan our Dialog Pay merchant QR code with any LankaQR-enabled banking or wallet app, or other QR networks supported by Dialog Pay
• Card and online payments (when available): Visa, Mastercard, American Express, UnionPay and other methods supported by the Dialog Pay payment gateway, completed on a secure payment page hosted by Dialog Pay

Some Marketplace products may be sold through Buy Me a Coffee, in which case its checkout and terms apply.

Pricing and Currency

Prices are stated in the Quotation or on the product page. Dialog Pay transactions are charged in Sri Lankan Rupees (LKR) unless stated otherwise. Where a price is shown in another currency, the LKR amount on the invoice or payment request is the amount payable. Your bank or card issuer may charge its own fees or currency conversion costs, which are your responsibility.

Making a Payment

• Always enter the exact amount shown on your invoice and include the invoice or order reference where your app allows it.
• Check that the merchant name displayed in your app matches Kavindu Manahara before confirming a QR payment.
• Keep your payment confirmation or transaction ID. We confirm receipt by email once the payment appears in our merchant account.
• A payment is only complete once it is received by us. We are not responsible for payments sent to the wrong QR code, account or amount.

Deposits and Milestones

Unless the Quotation states otherwise, client services require an upfront deposit before work begins, with the balance due on the milestones or delivery dates in the Quotation. We may pause work or withhold delivery of final files while an invoice is overdue.

Recurring Charges

We do not currently charge recurring payments. If we offer ongoing maintenance or hosting in future, we will only bill it with your written consent stating the amount, frequency and duration of the charges.

Payment Security

This website is served over HTTPS (TLS encryption). We never ask for, see or store your card number, CVV, banking passwords or PINs. QR payments are authorised inside your own banking or wallet app, and card payments are entered only on Dialog Pay's hosted payment page, which is certified to the PCI DSS standard. We will never ask for payment credentials by email, phone or chat.

Cancellation and Refund Policy

Client Services

• Before work starts: you may cancel and receive a full refund of your deposit.
• After work starts: you may cancel at any time in writing. You will be charged for work completed up to the cancellation date (by milestone or hours, as set out in the Quotation), and any amount paid beyond that is refunded.
• Completed and accepted milestones are non-refundable.
• If we cancel an engagement or cannot deliver the agreed scope, we refund all amounts paid for undelivered work.

Digital Products

Because digital products can be copied once downloaded, they are non-refundable after download or delivery, except where the product is materially defective or not as described and we cannot fix it within 14 days of your report. Duplicate or erroneous charges are always refunded.

How Refunds Are Made

• Request a refund by emailing contact@kavindu.me with your invoice number, transaction ID and reason.
• We respond to refund requests within 5 business days.
• Approved refunds are made to the original payment method through Dialog Pay where possible, or otherwise by bank transfer to an account in the payer's name. Cash refunds are not provided.
• Refunds are normally initiated within 7 business days of approval. The time for funds to reach you depends on your bank or card issuer.

Disputes and Chargebacks

Please contact us first so we can resolve any issue quickly. If you raise a dispute or chargeback with your bank or card issuer, we may provide invoices, communications and delivery records to Dialog Pay and the relevant bank to respond to it.

Delivery Policy

We do not ship physical goods. All services and products are delivered electronically:

• Client services: delivered as source code (e.g. via a Git repository), deployed websites, or files sent by email or a file-sharing link, on the timeline in the Quotation. Timelines depend on you supplying content, feedback and access on time.
• Digital products: delivered as a download link or file by email, normally within 24 hours of confirmed payment.

If you have not received your delivery within the stated time, contact us and we will resend it or resolve the issue.

Intellectual Property

For client services, ownership of the custom deliverables transfers to you once the project has been paid in full. We keep ownership of our pre-existing tools, libraries and know-how, and grant you a licence to use them as part of your deliverables. Open-source components remain under their own licences. Unless you ask us not to, we may show non-confidential work in our portfolio.

Digital products are licensed, not sold. The licence terms on the product page apply; unless stated otherwise, you may not resell or redistribute the product itself.

Your Responsibilities

• You must be at least 18 years old to make a payment.
• You must provide accurate information and have the right to use any content, credentials or materials you give us.
• You must not use our services or website for any unlawful purpose or to make fraudulent payments.

Warranties and Limitation of Liability

We perform services with reasonable skill and care and fix defects in our own deliverables reported within 30 days of delivery, free of charge. Otherwise, the website, products and services are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any engagement is limited to the amount you paid for it. Nothing in these Terms limits any rights you have under Sri Lankan consumer protection law.

Privacy

We handle your personal and payment information as described in our Privacy Policy and Cookie Policy.

Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute that cannot be resolved amicably is subject to the jurisdiction of the courts of Sri Lanka.

Changes to These Terms

We may update these Terms from time to time. Changes are posted on this page with a new "Last updated" date and do not affect payments or Quotations already agreed.
